Terms of Service

You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you use the Service on behalf of someone else or an organization, you represent that you have authority to bind them to these Terms.

You are responsible for your account and for keeping your credentials secure. Tell us promptly if you suspect unauthorized access. You must give us accurate information and keep it up to date.

You own the content you create in Wend — your tasks, habits, goals, and messages. You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, process, and display that content solely to operate, provide, and improve the Service. This license ends when your content is deleted from the Service.

Wend includes an assistant powered by third-party AI models. Its responses are generated automatically and may be inaccurate or incomplete. The assistant is a productivity tool — it does not provide medical, legal, financial, or other professional advice, and you should not rely on it as such. You are responsible for how you use its output.

You agree not to:

• break the law or violate the rights of others;
• probe, scan, or test the vulnerability of the Service, or interfere with its operation;
• access the Service by automated means or attempt to access other users' accounts or data;
• reverse engineer, decompile, or resell the Service, except where the law permits it despite this restriction; or
• use the Service to send spam or abusive content to others.

Parts of the Service may be offered for a fee, including subscriptions purchased through the App Store. Prices will be shown before you buy. Subscriptions renew automatically until cancelled; you can manage or cancel them in your App Store account settings. Payments made through Apple are subject to Apple's terms, and refunds are handled by Apple in accordance with its policies.

The Service — including its software, design, and branding — belongs to Awen and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app on your devices for personal, non-commercial use. Feedback you send us may be used without obligation to you.

Our Privacy Policy explains what information we collect and how we use it. By using the Service you agree to it.

You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if we are required to by law, or if we discontinue the Service. Upon termination, sections that by their nature should survive (including ownership, disclaimers, and limitations of liability) will survive.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL NEVER BE LOST — KEEP COPIES OF ANYTHING IMPORTANT.

TO THE FULLEST EXTENT PERMITTED BY LAW, AWEN WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

You agree to indemnify and hold Awen harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, or your violation of these Terms or the law.

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in San Francisco County, California, and you and Awen consent to their jurisdiction. Nothing in this section prevents either party from seeking relief in small-claims court.

We may update these Terms from time to time. If we make material changes, we will notify you in the app or by other reasonable means before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
